Terms of purchase and use
1. General
1.1 These general terms and conditions (“Terms of Purchase and Use”) apply when you as a consumer (“Customer”) place an order via www.VillaBlomstergren.se and associated pages, (“Website”). The agreement is concluded between you and Villa Blomstergren AB, organization no. 559366-5994 (“Villa Blomstergren”). Detailed contact details and other information about Villa Blomstergren can be found on the Website. The terms and conditions only apply to Customers who are consumers and who place orders via the Website. 1.2 In order to order on the Website, the Customer must be 18 years of age or older. Villa Blomstergren does not, according to Swedish law, accept credit purchases from persons under the age of 18. Villa Blomstergren reserves the right to refuse or change a Customer's order in individual cases (for example, if the Customer has provided incorrect personal information and/or has payment complaints).
1.3 Villa Blomstergren reserves the right to final sales and any image and typing errors on the Website, such as errors in product description or technical specifications, incorrect prices and price adjustments (such as changed prices from suppliers, currency changes) or incorrect information regarding whether an item is in stock. Villa Blomstergren has the right to correct such errors and to change or update the information at any time. If an incorrect price has been stated for an item that the Customer has ordered, Villa Blomstergren will of course notify the Customer of this and await the Customer's approval of the corrected price before Villa Blomstergren continues with the order. All image information on the Website should be seen exclusively as illustrations. Such illustrations cannot be guaranteed to reflect the number of items the Customer receives or the exact appearance, functions or origin of the item. Villa Blomstergren is not responsible for information on the Website that comes from a third party.
2. Agreement and Order
2.1 In order to make a purchase via the Website, the Customer must accept the Terms and Conditions. By accepting the Terms and Conditions, the Customer agrees to comply with the Terms and Conditions in their entirety, and acknowledges that he/she has read the information about personal data and consented to the use of personal data and cookies in accordance with Villa Blomstergren's Privacy Policy, see Privacy Policy.
2.2 A purchase agreement is only concluded when Villa Blomstergren has confirmed the Customer's order and the Customer has received an order confirmation from Villa Blomstergren by e-mail. Villa Blomstergren urges the Customer to save this order confirmation for any contacts with Villa Blomstergren customer service. The Customer may cancel their order until it has been confirmed by Villa Blomstergren. If the order is canceled, Villa Blomstergren will refund any payments that the Customer or its payment or credit card company has made in relation to the order.
3. Customer information etc.
3.1 Villa Blomstergren recommends that the Customer creates a user account before the Customer makes purchases on the Website. When the Customer registers their user account and/or is about to place an order, the Customer will be asked to provide certain personal information. The Customer confirms that the information the Customer fills in is correct and complete and is responsible for any incorrectly filled in information. Information about Villa Blomstergren's processing of personal information can be found in the Villa Blomstergren Privacy Policy, which is part of these Terms.
3.2 The Customer undertakes to ensure that no one other than the Customer can use the Customer's login details. The Customer may not disclose the username and password to any unauthorized person and shall ensure that documents containing the username and password are stored in such a way that unauthorized persons cannot access the information. The Customer shall immediately notify Villa Blomstergren if it is suspected that unauthorized persons have gained access to the Customer's password. The Customer is responsible for all purchases made with his login details if such notification has not been made.
3.3 If Villa Blomstergren suspects that the Customer is abusing their user account or login details or otherwise violating the Terms, Villa Blomstergren has the right to suspend the Customer. Villa Blomstergren also has the right to assign the Customer new login details.
4. Prices, fees and payment
4.1 When ordering via the Website, the prices stated on the Website apply. Prices are stated in Swedish kronor and include VAT. Prices do not include payment and shipping fees, which are stated separately.
4.2 The Customer can pay in the manner specified on the Website. Read more about our payment methods and discounts on the Website's Payment Terms. Villa Blomstergren has the right to charge the Customer already in connection with the order, unless invoice payment or another similar payment method has been chosen by the Customer and approved by Villa Blomstergren. In the event of invoice payment or partial payment, Villa Blomstergren or its partners may conduct a credit check. In such a case, you will be informed of this. Villa Blomstergren reserves the right not to always offer all payment methods, or to change the payment method if the one chosen by the Customer for some reason does not work at the time of purchase. Please note that any restrictions on payment options are stated on the Website.
4.3 After the payment order has been received by Villa Blomstergren, the payment will be made on the number of banking days announced at the time of payment. A Payment Order is never considered received before Villa Blomstergren has received the entire Transaction Amount. A banking day shall be considered a day (which is not a Saturday, Sunday or a public holiday) when banks are usually open for business and can process payment instructions in both Sweden and the country of the payee.
4.4 The User approves the payment transaction by consenting to the transaction being carried out via the User Account. The transaction amount is deducted from the User's Card in connection with the approval.
4.5 Payment orders cannot be revoked after they have been received by Villa Blomstergren.
4.6 When a payment transaction has been completed, this is indicated in the User Account. The information about the payment transaction constitutes the User's receipt that the payment transaction has been completed.
5. Promotions and offers
Villa Blomstergren may from time to time offer promotions on the Website that may have more favorable terms than those set out in these Terms, e.g. regarding payment or extended right of withdrawal. These more favorable terms apply as long as the promotion is active and for the specific products specified by Villa Blomstergren in connection with the promotion. Villa Blomstergren reserves the right to withdraw such promotions at any time. Upon termination or withdrawal of a promotion, these Terms apply without change. Offers on specific products on the Website are valid for a limited time and while stocks last.
6. Delivery and transportation
6.1 Goods that are in stock are normally delivered within the number of working days stated on the Website. Unless otherwise specifically agreed (e.g. in connection with booking goods that are not in stock), delivery will take place no later than 30 working days from the date that Villa Blomstergren has confirmed the order in writing through the order confirmation. 6.2 The expected delivery time of the goods is stated in the order confirmation, at checkout and/or on the relevant product page on the Website. In the event of a delivery delay, Villa Blomstergren will notify you of this and continue to monitor the order. Unless otherwise specifically agreed and a delivery takes more than 30 working days and this is not due to you as the Customer, you have the right to cancel the purchase.
6.3 If a package is to be collected, the Customer must do so within the time specified in the notification. Packages must normally be collected in person with valid identification and order number. The Customer always receives a notification showing where and when the package is to be collected. Notification can be made via e-mail, regular mail and, if the Customer has provided a mobile phone number, also via telephone call or SMS. If the Customer does not collect the package, Villa Blomstergren has the right to charge the Customer a fee of 250 SEK for work done and shipping fees. Please note that uncollected packages do not fall within the scope of the right of withdrawal or free returns.
7. Right of withdrawal
7.1 When purchasing goods on the Website, a 14-day right of withdrawal always applies in accordance with applicable consumer protection legislation. This means that the Customer has the right to cancel their purchase by notifying Villa Blomstergren within 14 days of the Customer or the Customer's representative receiving the ordered goods (the withdrawal period).
7.2 The right of withdrawal does not apply to the following types of goods:
- goods with broken seals (for example, dietary supplements, cosmetic products, electronics, scales and similar products);
- goods that can quickly deteriorate or become outdated (for example, dietary supplements, health foods and other foods);
- goods that have been manufactured according to the customer's instructions or that have otherwise been given a clear personal touch; sound or image recordings (for example, a CD) or computer programs with a broken seal;
- digital content that is delivered in a way other than on a physical medium (for example, computer programs, applications, games, music, videos or texts where access is by downloading from or streaming).
- Intimate products (e.g. underwear, swimwear, socks, tights) can only be returned if the item is unused and all labels are still attached.
The right of withdrawal can only be applied to entire sets, Villa Blomstergren does not accept returns of selected parts of a purchased set (you can return the entire unopened set).
7.3 By accepting the Terms, the Customer agrees that the right of withdrawal does not apply to digital content delivered in a manner other than on a physical medium.
7.4 In connection with an order for goods for which the right of withdrawal does not apply, the Customer will receive clear information about this. If a good has been sealed, the Customer may not break the seal if he wishes to exercise his right of withdrawal. The right of withdrawal therefore ceases when the Customer breaks the seal. Sealing also refers to technical sealing (for example, serial number).
7.5 If the Customer wishes to cancel the purchase, the Customer must, before the cancellation period has expired, send a clear and unambiguous message to Villa Blomstergren in the manner specified under Right of cancellation, Returns & Exchanges. The Customer must state their name, address and other relevant information, e.g. order number, invoice number and name of the product in the message. If the above message option is not desired by the Customer, the Customer can use the standard form for exercising the right of cancellation developed by the Swedish Consumer Agency (see www.konsumentverket.se ). Packages that are not collected from an agent do not fall within the scope of the right of cancellation and grant Villa Blomstergren the right to charge the customer 250 SEK in fees for work done and shipping costs.
7.6 When exercising the right of withdrawal, the Customer pays the return shipping and is responsible for the condition of the goods after the Customer has received the goods and during the return shipping. The goods must be returned within 14 days from the date on which notice of exercise of the right of withdrawal was given to Villa Blomstergren. The goods must be sent well packaged, in good condition and in the original carton. Returns must be made to Villa Blomstergren according to the methods and instructions stated on the Website, you can find these under Right of Withdrawal, Returns & Exchanges.
7.7 Sometimes Villa Blomstergren may offer free returns for certain goods. If free returns apply, this will be stated on the relevant product page on the Website.
7.8 When the Customer cancels their purchase, Villa Blomstergren will refund the amount that the Customer paid for the goods, including delivery costs. Exceptions apply to any additional delivery costs as a result of the Customer choosing a delivery method other than the standard delivery offered by Villa Blomstergren. When returning part of the order, the delivery cost will not be refunded. From the amount to be refunded, Villa Blomstergren has the right to deduct an amount corresponding to the decrease in value of the goods compared to the original value of the goods, if and to the extent that such decrease in value is due to the Customer having handled the goods to a greater extent than is necessary to determine their properties or function.
7.9 Villa Blomstergren will refund the amount as soon as possible, but no later than within 14 days from the date Villa Blomstergren received the Customer's notification of the exercise of the right of withdrawal. Villa Blomstergren may, however, wait with the refund until Villa Blomstergren has received the goods or the Customer has shown that the goods have been sent back, e.g. by means of a delivery receipt. The refund will be made to the Customer via the payment option chosen by the Customer, provided that nothing else has been agreed or that there are obstacles to such a refund.
8. Products with Special Terms and Conditions
- Please note that some products have “Special Terms” on the product page. For such products, the special terms set out in this section apply.
- The products are not delivered from Villa Blomstergren warehouses but directly from the supplier.
- After ordering a product with Special Terms and Conditions, you will be contacted by a shipping company to arrange a delivery date and time.
- Delivery will be made to the specified postal address (to the gate if you live in an apartment). If you live on an island with limited communication, pickup may need to be made at the nearest postal terminal or may take longer if the shipping company requires assistance from a third party.
- Shipping is included in the price, which means you will not be charged for the extra shipping. Please note that when you return an item, you will be charged for the shipping cost, up to 1200 sek depending on the product. In order for the return to be approved, the product must be packed in its original, undamaged packaging. If the packaging is damaged, a refund will not be approved.
- We reserve the right to expect longer delivery times if the item is out of stock at the supplier.
- We reserve the right to charge the customer a fee of up to SEK 500 if the package cannot be delivered on time due to incorrect information provided or if the customer does not respond when contacted by the shipping company.
- The customer is responsible for checking that the delivery contains all the items listed on the delivery note and that the package is complete when delivered. Any errors should be noted on the driver's delivery note.
- We reserve the right to invoice an additional cost in the event that you wish to change the delivery address and the shipping company charges an additional cost to make this adjustment.
9. Warranty and complaints
9.1 Some of Villa Blomstergren's goods may be covered by a warranty. Information about any warranty period and specific warranty conditions for each product can be found on the Website or in these Terms. The warranty for goods only covers original manufacturing defects, and thus does not cover defects that occur during or after a personal change to the function and appearance of the goods, such as rebuilding, upgrading or other configuration of the goods. The customer's order confirmation serves as proof of warranty.
9.2 The right of complaint covers goods that are faulty according to applicable consumer protection legislation. A customer who wishes to claim a fault in an ordered item must contact Villa Blomstergren as soon as possible after the fault is discovered via the contact details provided on the Website. Complaints made within two months of the Customer discovering the fault are always considered to have been submitted in a timely manner. The customer has a 3-year right of complaint for goods purchased on the Website.
9.3 Villa Blomstergren is responsible for the return shipping for approved complaints.
9.4 When the claimed product has been returned and the complaint has been approved, Villa Blomstergren will compensate the Customer in accordance with applicable consumer protection legislation. Villa Blomstergren strives for this to happen within 30 days of Villa Blomstergren receiving the complaint, but it may take longer depending on the nature of the product. Villa Blomstergren reserves the right to refuse a complaint if it turns out that the product is not defective according to applicable consumer protection legislation. When making complaints, Villa Blomstergren follows guidelines from the Swedish National Board of Consumer Complaints or equivalent boards in other European countries. 10. Links
10.1 Villa Blomstergren may link to other websites that are outside of Villa Blomstergren's control, and websites outside of Villa Blomstergren's control may link to the Website. Although Villa Blomstergren attempts to ensure that Villa Blomstergren only links to websites that share Villa Blomstergren's privacy and security practices as set out in the Privacy Policy, Villa Blomstergren is not responsible for the protection or confidentiality of information or personal data that the Customer provides on other websites. The Customer should exercise caution and read the privacy practices of the relevant website.
11. Force Majeure
11.1 Villa Blomstergren is not responsible for delays caused by circumstances that Villa Blomstergren has not been able to control, such as general labor disputes, war, fire, lightning, terrorist attacks, changes in government regulations, technical problems, faults in electrical/telephone/data connections or other communications, and faults or delays in services from subcontractors due to circumstances stated here. These circumstances shall constitute grounds for exemption that entail exemption from damages and other penalties. If any such situation should arise, Villa Blomstergren will inform the Customer both at the beginning and at the end of the period of the current situation. If the circumstance has lasted longer than two months, both the Customer and Villa Blomstergren have the right to cancel the purchase with immediate effect.
12. Changes to the Terms
12.1 Villa Blomstergren reserves the right to make changes to these Terms and Conditions at any time. All changes to these Terms and Conditions will be published on the Website. Changes will apply from the time the Customer has accepted the Terms and Conditions (in connection with a new purchase or when visiting the Website), or 30 days after Villa Blomstergren has informed the Customer of the changes. However, Villa Blomstergren recommends that the Customer stays updated on the Website regularly to be notified of any changes to the Terms and Conditions.
13. Invalidity
13.1 If any provision of these Terms is found by any court, authority or arbitration panel to be invalid or unenforceable, that provision and all other provisions shall be valid and enforceable to the fullest extent permitted by applicable law. The provisions declared invalid or unenforceable will be superseded by relevant legal guidance and advice.
14. Applicable law and disputes
14.1 Disputes shall primarily be resolved by mutual agreement after discussion with Villa Blomstergren's customer service.
14.2 If a dispute cannot be resolved in agreement with Villa Blomstergren's customer service, you as a customer can contact ARN (Allmänna reklamationsnämnden), which you can find more information about at www.arn.se. You can also file a complaint directly online via the EU Commission's platform for dispute resolution, which you can find via the following link http://ec.europa.eu/consumers/odr . If you file a complaint via this platform, your case will automatically be forwarded to the correct national dispute resolution body. This dispute resolution body will then contact us and try to resolve the dispute without involving the courts.
In the event of any dispute, Villa Blomstergren will follow decisions from ARN or a corresponding dispute resolution body.
14.3 Disputes concerning the interpretation or application of these Terms and Conditions shall be interpreted in accordance with Swedish law and shall be resolved in accordance with clause 13.2 above or, in the last resort, by a general court.
